NaturePhotoTours.com and its parent company, assure you that your personal information and user data will be kept private as much as is possible within normal business practices. The name, address, other personal information and payment information that a customer provides, together with information regarding the manner in which the customer uses this website, shall not shared by NaturePhotoTours.com except as necessary for our normal business purposes or as required by law or subpoena.

1. REGISTERING ---- In order to register for a Workshop, a $300 deposit is required. Once you have decided that you would like to participate in a Workshop, you should Register as soon as possible to assure a spot.
   
   The deposit can be made online via PayPal on our website, and we will send you an email acknowledgement, along with an attached Registration Form, which must be completed and mailed to us within 10 days.
   
   Or you can choose to download, print, fill out and mail the completed Registration Form along with a Check or Money Order.
   
   The cost of a Workshop is quoted in U.S. Dollars and must be paid in U.S. Dollars.
   
   If you do not have access to a printer, please call us, and we will gladly mail you a Registration Form. If you choose to Register by mail, your space in the Workshop will be held for 10 business days to allow time for us to receive your completed Registration Form and deposit or payment.
   
   NaturePhotoTours.com will email you to confirm receipt of your deposit. Additionally one of our staff will contact you by phone to welcome you as a participant, and to answer any questions you might have. If you Registered for a Workshop, and if within the next week you have not received confirmation from us, please call.
   
   By Registering for a Workshop, and when signing and returning the Registration Form, the person(s) Registering for the Workshop agrees that he/she has read, completely understood, and agrees to all the Terms and Conditions outlined here.
   
   
   
   
2. DISCOUNTS -- We offer a 5% or $100 discount (whichever is greater) to couples booking the same workshop. We also offer a 5 % or $100 discount (whichever is greater) to participants from previous Workshops.
   
   
   
   
3. FINAL PAYMENT ---- Payment in full is required 120 days prior to the date of the Workshop. If we do not receive your full payment within that time frame we will attempt to contact you by both email and phone. If we are unsuccessful in contacting you, and/or if final payment is not received then your reservation will be considered cancelled.
   
   Our Workshops are typically planned far in advance and while we do everything in our power to avoid it, price increases may occur due to any number of reasons. Significant currency fluctuations, increases in our cost of ground transportation, airfare, or accommodations, etc., all could serve to affect final pricing. Consequently, NaturePhotoTours.com reserves the right to amend our prices (Hey, if our costs decrease significantly, we're happy to pass along the savings to you also!) without prior notice. Any increase in Workshop pricing will not be sufficient grounds for any refund or cancellation, except as outlined under our Refunds and Cancellation Policy.
   
   
   
   
4. REFUNDS AND CANCELLATIONS ---- We cannot emphasize enough how strongly we recommend that all potential Workshop participants obtain Travel Insurance. Please check the Links Section of our site for a listing of a number of companies that offer Trip Insurance.
   
   Notice of cancellation must be received from you in writing, via Certified, Return Receipt Mail.
   
   UNLESS OTHERWISE NOTED in the description of a specific Workshop, the following applies;
   
   99+ days prior to the beginning of the Workshop -- 100% of the deposit
   
   99 to 45 days prior to the beginning of the Workshop -- 60% of the Workshop fee
   
   44 days or less prior to the beginning of the Workshop --100% of the Workshop fee
   
   All deposits and payments are non-transferable. If you participate in a Workshop, please note that no partial refunds are given for any unused portion of a Workshop.
   
   
   
   
5. CANCELLATION, DELAY OR ALTERATION OF A WORKSHOP BY US -- We do not generally cancel a Workshop due to low enrollment, nor do we charge a low participation supplement, however we do reserve the right to cancel any Workshop for any reason. If we do cancel a Workshop, we will refund all payments made by you. In the unlikely event that we do cancel a Workshop, NaturePhotoTours.com and its parent company are not responsible for any expenses incurred by you, including but not limited to airfare, travel insurance, etc., and we strongly suggest that you obtain travel insurance.

   We reserve the right to change the dates, itinerary, accommodations, etc. of any Workshop as conditions warrant. If a Workshop is delayed, or the itinerary changed due to inclement weather, road conditions, transportation delays, government intervention, sickness, or other contingency for which We or our agents cannot make provision, the cost of delays or changes is not included.
   
   
   
   
6. SUBSTITUTION OF A WORKSHOP LEADER- We reserve the right to substitute a Workshop Leader(s) in place of the Leader(s) originally specified, and in those instances, the substitution is not a basis for cancellation by the participant, or the issuing of any refund, except as provided in our normal cancellation policy.
   
   
   
   
7. WEATHER - We are not responsible for any additional costs that might be incurred due to inclement weather, or flight delays due to inclement weather. The possibility of inclement weather obviously is an inherent part of outdoor photography. We try to schedule our Workshops during peak times for the relevant subject matter, and there always exists the possibility of inclement weather. Unfortunately we are not able to issue refunds for shortened shooting opportunities, delays or cancellations caused by inclement weather.
   
   
   
   
8. LATE ARRIVAL FOR A WORKSHOP - If for whatever reasons you arrive late for the Start of a Workshop, in those instances where we are providing transportation inclusive with the Workshop, it is your responsibility to obtain transportation (at your expense) to wherever the Workshop's current location is. Included in your information packet will be Field contact information for the Workshop Leader(s), which will enable you to facilitate rendezvousing with the group. If you arrive late for a Workshop where we are not providing transportation, it is your responsibility to obtain transportation (at your expense) to wherever the Workshop's current location is.
   
   
   
   
9. PARTICIPANTS, PHYSICAL FITNESS and MEDICAL CARE - We reserve the right to decline, accept or retain any Workshop member as a participant of our Workshops at any time. The Workshop Leader will be the final arbiter of a participant's ability to participate or continue in the Workshop. This would include participants whose behavior is affecting the ability of the Workshop Leader to adequately conduct the Workshop, or a participant whose behavior is adversely affecting the other members of the group, or the group as a whole. If a Workshop participant is removed from the Workshop, a proportionate refund of unused services will be made.
   
   Unless otherwise noted, none of our Workshops involves extremely strenuous activity, however there is often walking for distances of up to ½ mile, walking on uneven terrain, walking at altitude, and of course you will be carrying your photographic equipment. You have assumed the responsibility to select an activity appropriate to your physical abilities and interests. You are personally responsible for being in sufficiently good health to undertake the activity. The Workshop Leader has the right to disqualify any participant at any time during the Workshop if the Leader feels that the participant is physically incapable and/or if a participant's continued participation will jeopardize either that individual or the group. By forwarding a signed Registration Form and deposit, you certify that you do not knowingly have any physical or other conditions or disability that would create risk for you or other participants. If a Workshop participant is removed from the Workshop, a proportionate refund of unused services will be made.
   
   You understand and agree that medical services or facilities may not be readily available during all or part of the trip, and that this includes emergency medical care, presence of physicians, and adequate medication. We assume no responsibility for medical care or any special dietary requirements you may have.
   
   
   
   
10. NOT INCLUDED IN THE TRIP PRICE-- Unless otherwise indicated, the following items are not included in the trip price, and all costs for these items are the sole responsibility of each Workshop participant: airfare, travel costs between your home and the gateway city and return home, any transportation or travel costs incurred prior to or after the Workshop, lunches and dinners, alcoholic beverages, entrance fees or costs related to optional sites or activities not included in the itinerary or a part of the Workshop, excess baggage charges, medical costs, personal items, incidental charges incurred at our accommodations such as internet access charges, phone calls or laundry, baggage or travel insurance, passport or visa expenses, and departure taxes.
    
    
    
    
11. TIPS and GRATUITIES - Tips and gratuities are not included in the cost of a Workshop, and you should not feel as though they are required. However, we have no policy that forbids Workshop Leaders or Assistants from accepting gratuities. If you wish to reward a Workshop Leader or Assistant for exceptionally good service, then by all means, feel free to do so.
    
    
    
    
12. OVERVIEW- NaturePhotoTours.com, its parent company, employees and all cooperating airlines and agencies act only in the capacity of agents in all matters of transportation, lodging and Workshop operation, and their liability is limited to the terms of the airline tickets, boat, and land accommodation contracts. We assume no responsibility however caused, for injury, loss, or damage to person or property in connection with any service resulting directly from: acts of God, detention, annoyance, delays, expenses arising from quarantine, strikes, thefts, pilferage, force majeure, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, terrorism, government restrictions or regulations and discrepancies or changes in transit or hotel services over which it has no control. All such losses or expenses must be born by the participants as Workshop rates provide for arrangements only for the time stated. Baggage is at the participants risk entirely.
    
    As a Workshop participant you understand and agree that travel with a group invariably involves compromise to accommodate the diverse desires, goals, personalities, and abilities of group members. You further understand and agree that while itineraries are carefully planned, they are not a guaranteed schedule of activities, events, or participation. We will do our utmost to deliver the itinerary as outlined. However, participants must allow for flexibility and changes deemed necessary by the Workshop Leader as there may be situations beyond our reasonable control due to geographic, climatic, physical, or governmental restrictions that will cause further changes in timing, locations, and activities. You understand and agree that there are no discounts or refunds for activities curtailed or otherwise affected by such circumstances.
    
    You understand that you before participating in one of our Workshops you will have to sign a Waiver of Liability.
    
    We shall be responsible to the Workshop Participants as set forth in the Workshop description and as outlined in our Terms and Conditions, except to the extent such services and accommodations cannot be supplied due to delays, or other causes beyond our control. In the event the services and accommodations cannot be provided due to the above reasons, or the Workshop Leader amends the itinerary and/or accommodations after the Workshop has commenced, (if it is determined to be in the best interest of participants), or in the event services are not used due to voluntary omission by the Workshop participants, refunds will not be granted. The Workshop participant waives any claim against NaturePhotoTours.com and its parent company, in the absence of negligence on its part, for any damage or loss of property or injury to or death of any person due to any act of negligence of any hotel or any other person rendering any of the services and accommodations in the ground portion of the itinerary. We shall not be responsible for any delays, substitution of equipment or any act or omission whatsoever by the carrier, its agents, servants and employees and Workshop participants waive any claim against Naturephototours.com and its parent company, arising therefrom.
    
    If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
    
    This agreement constitutes the entire agreement between the Workshop Participant and NaturePhotoTours.com (and its parent company), with respect to this Photo Workshop product and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and NaturePhotoTours.com (and its parent company) with respect to this Photo Workshop product. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.
